General Terms and Conditions (GTC)

for the Mediation of Individual Tourist Services

Orient Discovery – Düsseldorf

§ 1 Scope of Application

These General Terms and Conditions (GTC) apply to all mediation services provided by Orient Discovery via its website and through other communication channels (e.g. email or telephone).

The services mediated include, in particular:

  • Day trips

  • Boat tours

  • Snorkeling and diving excursions

  • Desert safaris

  • Cultural tours

  • Airport transfers and other transfer services

These GTC apply exclusively to the mediation of the above-mentioned individual tourist services. The contractual partner responsible for providing the booked service is solely the respective service provider.

§ 2 Role as an Intermediary

Orient Discovery acts solely as an intermediary between the customer and the respective local service provider.

Orient Discovery is neither a tour operator nor the provider of the mediated services.

The contract for the booked service is concluded exclusively between the customer and the respective service provider.

The respective service provider is solely responsible for the nature, scope, execution, and quality of the service.

Orient Discovery does not guarantee the successful performance or availability of the mediated service.

§ 3 Conclusion of Contract

The presentation of services on the website does not constitute a legally binding offer within the meaning of Sections 145 et seq. of the German Civil Code (BGB).

By completing a booking, the customer submits a binding offer to conclude a contract with the respective service provider.

The contract is concluded only upon confirmation of the booking by the respective service provider or by Orient Discovery acting on behalf of the service provider.

The customer will receive the booking confirmation in text form (e.g. by email).

§ 4 Prices and Payment Processing

The final prices stated at the time the contract is concluded shall apply.

Where indicated, Orient Discovery may charge a mediation or service fee.

Orient Discovery is authorized by the respective service provider to collect payments on behalf of and for the account of the service provider (collection authorization).

Once the full payment has been received by Orient Discovery, the customer's payment obligation towards the respective service provider shall be deemed fulfilled.

Depending on the specific offer, payments may be be made via PayPal, credit card, bank transfer, or any other payment methods offered on our website.

§ 5 Service Description

The respective service description provided by the service provider shall be decisive.

Changes due to weather conditions, safety considerations, official orders, or operational requirements remain reserved.

Information regarding duration, itinerary, route, or program schedule is approximate and may be adjusted for justified operational reasons.

§ 6 Cancellation, Rebooking, and Withdrawal

Cancellation, rebooking, and withdrawal are governed exclusively by the terms and conditions of the respective service provider.

These conditions will be made available to the customer before the booking is completed.

Refunds shall only be made in accordance with the applicable terms of the respective service provider.

Upon request, Orient Discovery will assist the customer in communicating with the service provider.

§ 7 Right of Withdrawal

Pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for contracts concerning leisure activities provided on a specific date or within a specified period.

§ 8 Liability

Orient Discovery is liable solely for the proper mediation of the booked service.

The respective service provider bears sole responsibility for the execution, safety, quality, and fulfillment of the mediated service.

In cases of slight negligence, Orient Discovery shall only be liable for breaches of essential contractual obligations (cardinal obligations) and only for foreseeable damage typical for this type of contract.

The above limitations of liability shall not apply in cases of intent, gross negligence, injury to life, body, or health, or where mandatory statutory provisions provide otherwise.

§ 9 Customer Obligations

The customer is obliged to provide all information required for the performance of the booked service completely and accurately.

Any health restrictions or other circumstances that may significantly affect the safe execution of the service must be communicated before booking.

Any complaints must be reported immediately to the respective service provider on site.

§ 10 Force Majeure

If a mediated service cannot be performed, or can only be performed in part, due to force majeure, official measures, natural events, political unrest, security risks, or comparable circumstances, the terms and conditions of the respective service provider shall apply.

In such cases, Orient Discovery assumes no independent obligation to perform the service.

§ 11 Data Protection

Personal data is processed in accordance with the current Privacy Policy of Orient Discovery.

§ 12 Consumer Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform.

Orient Discovery is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Applicable Law

German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a consumer, mandatory consumer protection provisions of the country in which the customer has their habitual residence shall remain unaffected.

The statutory provisions governing jurisdiction shall apply.
