General Terms and Conditions (GTC)
for the Mediation of Individual Tourist Services
Orient Discovery – Düsseldorf
§1 Scope of Application
These General Terms and Conditions apply to all mediation services offered via the website of Orient Discovery in the field of individual tourist services, in particular:
Day trips
Boat tours
Snorkeling and diving excursions
Desert safaris
Cultural tours
Transfers
Orient Discovery acts exclusively as an intermediary.
§2 Position as Intermediary
Orient Discovery mediates individual tourist services between the customer and the respective local service provider in Egypt.
Orient Discovery is not the organizer of the offered services.
The contract for the execution of the booked service is concluded exclusively between the customer and the respective service provider.
Orient Discovery does not provide travel services itself and assumes no obligation for the performance of the mediated services.
§3 Conclusion of Contract
The presentation of services on the website does not constitute a binding offer.
By submitting a booking, the customer makes a binding offer to conclude a contract with the respective service provider.
The contract is concluded upon acceptance or confirmation by the service provider.
The customer will receive a booking confirmation by email.
§4 Prices and Payment Processing
The final prices displayed at the time of booking shall apply.
Orient Discovery may charge a mediation or service fee.
Payment is made via the available payment providers.
Orient Discovery does not store complete credit card details.
Orient Discovery may accept payments in the name and on behalf of the service provider.
§5 Description of Services
The content and scope of the mediated services are determined by the respective description provided by the service provider.
Changes to the schedule due to organizational, safety-related, or weather-related reasons remain reserved by the service provider.
Information regarding duration, route, or schedule may vary due to local conditions.
§6 Cancellation, Rebooking and Withdrawal
Cancellation and rebooking conditions are governed by the terms of the respective service provider.
These conditions are displayed to the customer before completion of the booking.
Refunds are granted exclusively in accordance with the conditions of the service provider.
§7 No Right of Withdrawal
Contracts for leisure services with a specific date or period are excluded from the statutory right of withdrawal pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB).
§8 Liability
Orient Discovery is liable solely for the proper mediation of the service.
The respective service provider is exclusively responsible for the performance of the mediated service as well as for any personal injury, property damage, or financial loss arising in connection with its execution.
Orient Discovery’s liability is limited to intent and gross negligence, unless essential contractual obligations have been breached.
The limitation of liability does not apply in cases of injury to life, body, or health.
§9 Customer Obligations
The customer is obliged to provide all information required for the execution of the service completely and truthfully.
Any special health conditions or risks must be communicated before booking.
Complaints must be reported immediately to the service provider on site.
§10 Force Majeure
If a service cannot be performed or can only be performed partially due to force majeure (e.g., natural events, official orders, political unrest, or security situations), any possible refund shall be governed by the conditions of the respective service provider.
§11 Data Protection
Personal data is processed in accordance with the Privacy Policy of Orient Discovery.
§12 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

Orient Discovery is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§13 Applicable Law
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, the statutory provisions regarding jurisdiction shall apply.
